Public ordering remains closed. The public brief is a preview; private customer briefs require a verified paid order. Google Analytics and Meta Pixel are not connected.
1. Who is responsible
Jakub Smejkal, trading as MomentAnthem, is responsible for deciding how your personal information is used. We are a Czech self-employed business (OSVČ), IČO 04457609.

For privacy questions or requests, email support@momentanthem.com or call +420 736 264 054. This policy covers visitors, people who contact us, purchasers and people whose details a purchaser includes in a song brief.
2. What happens on the site today
The public order, contact and brief-preview forms do not place orders or submit stories while checkout is closed. Public brief-preview answers stay in the open page; reloading or leaving clears them. If you copy or download your answers, that copy is under your control.
Private customer brief: a separate page is being introduced for verified paid orders. When available for your order, choosing Continue or Save for later sends a draft to private Wix storage. Submitting the final brief records your answers, your instruction to begin, and the delivery date. Draft versions help prevent accidental overwrites. Your private access link can reopen the brief; keep it confidential. A temporary access key may be stored in your browser’s session storage so reloading works. We do not store your story in browser storage or send it to analytics. The private page cannot be opened with only an order number and email.
Visiting the site still involves normal hosting and security processing by Wix, such as handling your IP address, browser request and technical logs. Sending us an email or calling us is separate from using the preview form and does disclose the information you choose to send.
Google Analytics and Meta Pixel are planned, but are not currently installed. Before either is activated, this notice and the cookie controls will be updated for that configuration. Optional tracking will require your prior choice. Brand fonts are served with the website rather than requested from Google Fonts.
The order and production sections below describe how we will handle information when purchases open; they do not mean a preview form has placed an order or sent us your story.
3. Information we use and where it comes from
- Contact information: your name, email, telephone number if provided, and messages you send us.
- Order information: once ordering opens, your order reference, country and billing details, selected service, transaction status, tax information and relevant acceptance or consent records. The payment provider handles full card details; do not put these into a message or brief.
- Creative information: the recipient’s first name or nickname, your relationship, occasion, memories, preferred language, pronunciation, musical preferences and other details you choose to provide. This may identify you or the recipient.
- Technical information: IP address, browser and device characteristics, access times, pages requested, errors and information needed to keep the site secure.
- Your choices: privacy settings and, if introduced, the optional permissions you give or withdraw.
We receive creative information from the purchaser. We do not search social profiles to enrich the brief. Share only what is needed: do not include medical details, financial information, identity documents, passwords, a child’s school or address, or another person’s private contact details.
Please make sure you have an appropriate basis to share details about someone else and, where appropriate, direct them to this policy. If we receive information about you from a purchaser, you can ask about it using the contact details above. We will meet any applicable duty to provide you with privacy information, subject to the lawful exceptions.
4. Why we use it
| Purpose | Legal basis, where required |
|---|---|
| Answer a question or take steps you request before ordering. | Steps toward a contract; legitimate interests in responding to other enquiries. |
| Accept payment, manage an order, create and deliver a song, provide revisions and another MP3 copy. | Performance of our contract with the purchaser. |
| Use limited ordinary details about a gift recipient to make the commissioned song. | Legitimate interests in fulfilling a personal gift, balanced against the recipient’s privacy and rights. We minimize the details used. |
| Keep required invoices and tax records. | Compliance with applicable legal obligations. |
| Secure the site, prevent misuse, maintain records of requests and deal with disputes. | Legitimate interests in protecting the service and establishing or defending claims; legal obligations where applicable. |
| Use optional analytics or advertising technology, if introduced. | Your consent, obtained before those tools are used. |
| Publish a customer story, song or testimonial for promotion. | Separate permission for the specified use; this is not a condition of purchase. |
Optional musical preferences can be left out. Once purchases open, we will explain which details are needed to fulfil an order; without an email address, payment and a usable brief, we cannot provide the service. We do not use your personal data for decisions with legal or similarly significant effects made solely by automated means.
5. Providers and sharing
Access is limited to the people and providers who need it for the purposes described here. We do not give advertisers your song brief, contact messages or private lyrics.
- Wix — website hosting, currently in use. Wix handles hosting and technical operations. When the order and contact integrations open, the relevant records will be stored in access-restricted Wix systems. See Wix’s Privacy Policy.
- Email and telephone services. The providers used to send and receive a message or call handle its delivery. Only the people handling your request should access its content. Do not email information unnecessary for your enquiry.
- Payments — not active on this site yet. Checkout will identify the selected payment provider and link to its notice before collecting payment details. It may process information independently for fraud prevention and legal compliance. We receive order and payment status information, rather than using brief fields to collect card numbers.
- Suno — planned music-production provider. Production may involve sending the relevant lyric draft and sound instructions to Suno. Our process is to exclude purchase emails, billing information and the full raw brief, and use only names or story details genuinely needed in the song. Suno’s terms grant it broad rights over submitted and generated content, including rights connected with improving, promoting and operating its services. It may retain content independently; private creation settings are not a promise that the provider makes no further use of it. Read Suno’s Privacy Notice and Terms of Service before sharing material you consider confidential.
- Google Analytics and Meta Pixel — planned, currently inactive. If introduced and accepted, these tools may receive device/browser identifiers, page and event information and technical data. Google Analytics would help us understand site use; Meta Pixel would measure advertising and support relevant advertising. Their notices are Google Privacy and Meta Privacy. We will describe the actual setup before activation.
We may also share the minimum necessary records with professional advisers, authorities or courts where required by law or needed for a legitimate claim. Some providers act on our instructions; others decide aspects of their processing under their own notices. We do not promise that deleting our working copy automatically deletes every copy a provider lawfully retains.
6. Processing outside your country
We are based in the Czech Republic. Wix and production or other service providers may operate in the United States and other countries, so information may be processed outside the country where you live, including outside the European Economic Area or UK.
Where a restricted transfer requires a safeguard, we use the applicable lawful mechanism, such as an adequacy decision or appropriate contractual safeguards, and assess any additional measures needed. A provider’s location alone does not establish that a transfer is permitted. We will verify the relevant arrangements before sending order or production data through a new provider. You can contact us for information about the safeguards relevant to your data.
7. How long we keep information
| Information | Our retention policy |
|---|---|
| Unsaved preview answers | Only in the open page. Copies you download or make yourself remain under your control. |
| Detailed production brief and working drafts | Normally 90 days after final delivery and completion of revisions, then deleted from our working records. Relevant parts may be kept longer for an unresolved issue or legal requirement. |
| Delivered MP3 and minimum retrieval information | 12 months after final delivery so you can request another copy. This is not a promise of permanent storage. |
| Routine enquiries | Normally 12 months after the enquiry is resolved. |
| Minimum contract and dispute records | Normally up to 3 years after completion; longer only where a live dispute, applicable limitation period or legal obligation requires it. We retain only the relevant information. |
| Tax and accounting records | For the period required by the applicable tax or accounting rule. This depends on the record and our obligations; some records may require up to 10 years. A full personal story is not needed on an invoice. |
| Cookie-setting preference | Up to 6 months in this browser, after which a new choice is needed if optional tools are offered. |
We review deletions regularly and restrict records held for legal reasons. Backup and provider-controlled copies can follow separate retention schedules; they should not be used to restore expired material to active production. Provider notices explain their independent retention. If you ask for early deletion, we will explain any information we must retain and any effect on our ability to resend your song.
9. Your privacy rights
Depending on the law that applies, you may ask to access your information, correct it, delete it, restrict its use, receive a portable copy, object to processing based on legitimate interests, or withdraw consent. Where applicable, you can also opt out of sale, sharing or targeted advertising and appeal a denied request. We do not sell customer records for money, and no advertising-related sharing through Google Analytics or Meta Pixel is currently active.
Email support@momentanthem.com with enough information to locate the relevant record. We may request proportionate verification before disclosure; do not send identity documents unless we specifically explain why they are needed. We respond within the applicable legal time limit, normally one month for GDPR requests, and explain any lawful extension or refusal. We will not penalize you for exercising a right.
You can complain to the Czech Office for Personal Data Protection, the UK Information Commissioner’s Office, or another competent authority. You do not have to complain to us first.
10. Children and sensitive details
Purchasing and direct submission are intended for adults aged 18 or over. An adult may commission a gift about a child but should have appropriate authority and share only the minimum ordinary details. We do not need a child’s address, school, contact information or medical history.
We do not request sensitive information about health, religion, sexuality, ethnicity, biometrics or criminal history to make a song. Please leave it out. If you believe we have received a child’s direct submission or unnecessary sensitive information, contact us so we can assess and remove it where appropriate.
11. Security and updates
We use access restrictions and appropriate technical and organizational measures to protect the information we control. No internet service can guarantee absolute security. Please keep your download links and copies private and do not put confidential information into an ordinary message.
We will update this policy when the service or data handling changes and show the revision date at the top. Where required, we will give additional notice or obtain a new choice before a materially different use. Contact us if you would like a copy of an earlier version relevant to your order.
